Legal Challenges to Vape Bans Meet Judicial Resistance

Two legal challenges to Michigan’s ban on flavored nicotine-based vaping products have been rebuffed – for now.

A lawsuit brought in Houghton County Circuit Court last week by 906 Vapor owner Mark Slis has been transferred to the Michigan Court of Claims. There, Judge Cynthia Diane Stephens declined to issue a temporary restraining order yesterday, but did schedule a hearing for today.

Pretty much the same thing happened in a federal suit brought by a Grand Rapids retailer in U.S. District Court in the Western District of Michigan. Judge Robert Jonker denied a request for a temporary restraining order, but is still considering a request for a preliminary injunction.
