Dixon Denied Bond for the Murder

Evan Dixon has been denied bond in the 97th District Court. This morning Dixon, 59 years old, stood before district court for arraignment on two felony charges. Dixon is charged with first degree murder premeditated and a felony firearm charge, after being arrested on Monday night. Dixon is accused of the murder of 53 year old, Theron Duncan at the Douglass House – Armando’s Restaurant earlier this week. The victim’s name from Monday’s shooting was officially released during today’s arraignment.

“The court at this time is pursuit to MCR 6.106 sub b. Sub 1. Sub a. Sub i. Going to deny pretrial release to Mr. Dixon. Given the nature of the charges. And again set this matter for a preliminary examination within 21 days.” – Judge Nicholas Daavettila, 97th District Court – Houghton County

Dixon’s lawyer David M. Gemignani will help him find replacement council with Karl Numinen. Gemignani has a personal relationship with the defendant, and wishes to separate his professional work and personal relationship. Additionally 97th District court judge Nicholas Daavettila will request a new judge preside over future proceedings, as he also has 30 years of professional experience with the defendant. The state Attorney General’s office will likely have the case tried before Magistrate Nicole Jollimore. A preliminary exam will be scheduled within the next 21 days.
